Defective Items: Any defective items must be reported to Critical Tool within 30 days of order. As a distributor Critical Tool Inc. has no control over certain aspects of product quality. There are items that may have a natural flaw or may have a service life less than what may be expected; natural flaws and failure to meet individual expectations are not considered defects. Critical Tool, Inc. will not be liable for any defective items NOT reported within the 30-day policy. Any guarantee that is offered by the product manufacturer, must be addressed by contacting the manufacturer directly. Normal wear and tear of an item does not constitute defectiveness. Acceptance of returns on any item said to be defective will be made at the discretion of Critical Tool, Inc. Critical Tool, Inc. assumes no product liability. Buyer assumes all risk pertaining to use and application of any purchase.
Undeliverable Items: Items returned to any Critical Tool warehouse that are undeliverable for any reason and have reached the maximum number of delivery attempts by the carrier can be reshipped at the customers expense to an alternative location. If the customer prefers a credit for the order, shipping costs cannot be refunded, and a 20% restocking fee will be applied.
Custom Orders: Any custom orders are non-refundable and non-returnable. Any imprinted logo items are non-refundable.
Special Orders: Periodically we may be able to supply for a customer an item that is not in our normal inventory (non-stock item) or does not appear on our website. These items are non-refundable and non-returnable.
Prices: Prices shown are subject to change. All published prices are in U.S. dollars and must be paid in U.S. dollars. Critical Tool is not responsible for typographical errors. In the event a typographical error occurs, we will attempt to rectify any errors on a case-by-case basis.
Prices on Other Websites: Our products may be featured on other third-party websites and may display information about the product, including, but not limited to, the product's name, description and pricing. Since we have no direct control over these third-party websites, Critical Tool is not responsible for the accuracy of this information.

Local Safety Standards and Regulations: Products sold by Critical Tool are designed to meet stated U.S. safety standards and regulations. Because local safety standards and regulations vary, Critical Tool cannot guarantee that our products meet all applicable requirements in each locality. The purchaser assumes responsibility for compliance with such safety standards and regulations in those localities in which the products will be shipped, sold and used.

Critical Tool shall not be subject to and disclaims: (1) any other obligations or liabilities arising out of breach of contract or of warranty, (2) any obligations whatsoever arising from tort claims (including negligence and strict liability) or arising under other theories of law with respect to products sold or services rendered by Critical Tool, or any undertakings, acts or omissions relating thereto, and (3) all consequential, incidental and contingent damages whatsoever.
Exclusion of Warranties/No Warranties Disclaimer: Buyer acknowledges that Seller is not the manufacturer of the products or goods sold. The implied warranties of merchantability and fitness for a particular purpose and all other warranties, express and implied, are excluded from this transaction and shall not apply to the goods sold. In no event shall Seller be liable to Buyer for indirect, special or consequential damages or for loss of anticipated profits on any claim of any kind resulting from any order hereunder.
These terms and conditions shall constitute the entire agreement between Critical Tool and the purchaser, and shall be governed by and construed according to the laws of the state of Illinois and the United States of America. Orders placed constitute an agreement to the above terms.
